2.6 Age and Accuracy of Date of Birth: The Platform is for people aged 18 or older. You must give your real date of birth. If we learn that an account belongs to someone under 18, or that the date of birth given is false, we may lock the account and delete its data.

3. Nature of the Platform & Disclaimer of Employment Relationship

3.1 Intermediary Status: RiseFlake operates as an online intermediary platform that connects job seekers with employers and recruiters. We are NOT an employment agency, recruitment firm, or employer.

3.3 No Contractual Relationship: RiseFlake is not a party to any employment contract, agreement, or relationship formed between job seekers and employers through the Platform. All employment terms, conditions, compensation, and arrangements are solely between the employer and employee.

3.4 Independent Verification Required: Users must independently verify all information, including job postings, employer legitimacy, candidate credentials, and company details. We do not conduct background checks, employment verification, or credential authentication.

  • Create professional profiles with truthful and accurate information
  • Upload resumes and professional credentials
  • Search for and apply to legitimate job opportunities

However, by posting User Content, you grant Bold India Platforms Private Limited a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your User Content for the purpose of:

  • Operating, maintaining, and improving the Platform

6.5 Content Removal: We reserve the right, but have no obligation, to monitor, review, edit, or remove User Content that violates these Terms, is inappropriate, or for any other reason at our sole discretion.

7. Job Postings & Application Process

7.2 Job Seeker Obligations: Job seekers represent and warrant that:

  • All information in profiles and applications is truthful and accurate
  • Uploaded documents (resumes, certificates) are genuine and belong to them
  • They have the legal right to work where they are applying
  • They will respond professionally to employer communications

7.3 Platform Role: RiseFlake's role is limited to facilitating connections. We do NOT:

  • Verify the authenticity of job postings or employer companies
  • Conduct background checks on employers or job seekers
  • Guarantee the accuracy of posted salary ranges or benefits
  • Verify educational credentials or work experience
  • Mediate employment disputes or disagreements
  • Guarantee responses to applications or interviews

7.4 Due Diligence: Users must conduct their own due diligence before entering into any employment relationship, including verifying company legitimacy, job details, and conducting interviews.

8. Free Services & Payment Terms

8.1 Free Platform: RiseFlake currently provides all its services completely free of charge to all users. There are no paid plans, subscriptions, premium tiers, or in-app purchases available on the Platform at this time. All features — including job discovery, profile building, networking, job posting, candidate search, chat, and all other functionalities — are available to every user at no cost.

8.2 No Payments Required: Users are not required to make any payment to access or use any feature of the Platform. Since no payments are collected, no refunds are applicable. For more details, please refer to our Refund Policy.

8.3 Future Paid Services: We reserve the right to introduce paid features, premium plans, or subscription-based services in the future. If and when paid services are introduced:

  • Users will be notified in advance via email, in-app notification, or a prominent notice on the Platform
  • Clear pricing, billing terms, and refund eligibility will be disclosed before any purchase
  • These Terms and the Refund Policy will be updated accordingly
  • Existing free features will continue to remain accessible
  • All payments, if introduced, will be processed through secure, trusted payment gateways (e.g., Razorpay) in compliance with applicable laws

8.4 Third-Party Charges: RiseFlake is not responsible for any charges imposed by your mobile carrier, internet service provider, or any third-party service accessed through the Platform. Standard data and messaging rates from your carrier may apply.

9. Privacy & Data Protection

9.1 Privacy Policy and Consent: Your use of RiseFlake is governed by our Privacy Policy, which is incorporated into these Terms and explains how we collect, use, store, share and delete your personal data under the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 and other applicable laws. Accepting these Terms is not consent to optional processing. Promotional messages, a public and searchable profile, recruiter visibility of your email or phone number, Find Nearby, phone-contact sync and location in assessments are separate choices that you can give or withdraw at any time in Settings, and none of them is a condition of using the core service.

9.2 Public Profile Licence: You grant RiseFlake a non-exclusive, worldwide, royalty-free licence to host, display and index the content of your profile on the Platform and, while Profile Visibility is switched on, to show it on public pages so that search engines may index it. You can switch this off at any time under Settings → Profile Visibility; we remove your page from our public directory within about 15 minutes. Search-engine caches and copies made by other people are outside our control.

9.3 Feature-Specific Terms: Some features need extra permissions:

  • Find Nearby is optional and uses your precise location as described in the Privacy Policy (Section 5.2). If you decline or revoke location permission, every other feature remains available.
  • Phone contacts (Android app) is optional. By allowing the permission you confirm that you use it for your own personal networking, that you are entitled to upload the contacts on your device, and that you understand they are uploaded to our servers as described in Section 5.1 of the Privacy Policy. You must not use the feature to harvest other people’s data. You may withdraw at any time.
  • Assessments. Where the recruiter, company or college running an assessment enables integrity checks, you agree to the monitoring described in Section 5.3 of the Privacy Policy (camera preview, microphone level, tab-switch and full-screen events, IP address and, if required, location). If you decline, you may not be able to take that assessment.

9.4 Communications: We send service messages (one-time passwords, application and interview updates, security and policy notices), which you cannot opt out of while you hold an account, and promotional messages, which are optional. Every promotional email has an unsubscribe link, and you can turn off notifications in Settings or your device.

9.5 Other People’s Data: If you enter or upload personal data about another person (for example a referral, a teammate, a placement officer’s contact details, or your address book), you confirm that you have a right to do so, that it is accurate, and that you will not misuse it. You are responsible for that data.

9.6 Your Duties as a Data Principal: You agree to give accurate information, not to impersonate another person, not to suppress material information, and not to file false or frivolous grievances or complaints. Breach of these duties can lead to account action and may attract penalties under the Digital Personal Data Protection Act, 2023.

9.7 Recruiters, Employers, Colleges and Organisers as Independent Data Fiduciaries: When you receive personal data of candidates, students or participants through the Platform you become an independent Data Fiduciary for your copy and you agree to:

  • use it only for the specific recruitment, placement or event purpose for which it was shared — not for unrelated marketing, resale, lead generation or building databases;
  • not scrape, crawl or bulk-export Platform data, and not contact people in volumes or ways that amount to spam;
  • protect it with reasonable safeguards (access control, encryption of exports, no shared logins) and disclose it only to people who need it;
  • not share candidates’ contact details with third parties or upload them to other platforms;
  • delete or anonymise it when the purpose ends, when the person asks, or when we tell you the person withdrew;
  • not process personal data of anyone under 18 obtained through the Platform;
  • notify us at privacy@riseflake.com within 24 hours of becoming aware of any personal-data breach involving data obtained from the Platform, and cooperate with regulators;
  • answer the person’s access, correction, erasure and grievance requests directly and comply with the Digital Personal Data Protection Act, 2023 and anti-discrimination law.

Colleges and institutions must in addition have authority to upload student data, give students a notice before uploading or inviting them, and use invitation flows that let each student create and control their own account. For data an institution uploads, the institution decides the purpose and RiseFlake processes it on the institution’s instructions on the Platform. We may suspend access, remove data and take legal action for breach of this clause.

9.8 Rights Requests and Grievances: To access, correct or erase your data, withdraw consent, nominate a representative or make a complaint, use Settings, the delete-account form, or email privacy@riseflake.com. Our Grievance Officer’s details are in the Privacy Policy (Section 18) and on the Regulatory & Other Info page.

11. Indemnification

You agree to indemnify, defend, and hold harmless Bold India Platforms Private Limited, its parent, subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising from or related to:

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by Bold India Platforms Private Limited. We have no control over and assume no responsibility for the content, privacy policies, terms of service, or practices of any third-party sites or services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such third-party content, goods, or services.

We strongly advise you to read the terms of service and privacy policies of any third-party websites or services that you visit.

13. Modification of Terms & Services

13.1 Terms Modification: We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Material changes will be communicated through:

  • Email notification to your registered email address
  • Prominent notice on the Platform
  • In-app notification

Changes take effect immediately upon posting for new users, and after the notice period (minimum 7 days) for existing users. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

13.2 Service Modification: We reserve the right to modify, suspend, or discontinue any aspect of the Platform or Services, temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of Services.

14. Account Termination, Suspension & Deletion

14.1 Termination by User: You may delete your account at any time from Settings → Delete Account, through the delete-account request form on our website, or by emailing privacy@riseflake.com. Your account is locked immediately (we may verify your identity first), and we erase or irreversibly anonymise your personal data within 30 days, except a small set of records kept for legal, security and audit purposes for the limited periods listed in Section 10.2 of the Privacy Policy. Deletion cannot be undone. It does not reach copies already held by recruiters, companies or other users as independent Data Fiduciaries. You may instead Hibernate your account to hide it without losing data. We may suspend or terminate accounts for violation of these Terms, fraud, or as required by law.

14.2 Account Hibernation: If you wish to take a break without losing your data, you may Hibernate (deactivate) your account. While hibernated, your profile will not be visible to other users and you will not receive communications. You can reactivate your account at any time by logging back in.

15.2 Jurisdiction: Subject to the arbitration clause below, you agree that any legal action or proceeding arising out of or relating to these Terms or the Platform shall be instituted exclusively in the courts located in Pune, Maharashtra, India. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue.

15.3 Amicable Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiations between the parties. We encourage you to connect with us directly at support@riseflake.com or via WhatsApp at +91 92252 20170 before pursuing formal dispute resolution.

15.4 Arbitration Agreement: If negotiations fail within 30 days, either party may refer the dispute to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be:

  • Conducted by a sole arbitrator mutually appointed by the parties

  • Conducted in English
  • Subject to the procedural rules of the Indian Council of Arbitration

The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.

15.5 Exceptions to Arbitration: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights or confidential information.

15.6 Class Action Waiver: TO THE EXTENT PERMITTED BY LAW, ALL CLAIMS MUST BE BROUGHT IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

16. General Provisions

16.1 Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Bold India Platforms Private Limited regarding the Platform and supersede all prior agreements and understandings.

The remaining provisions shall continue in full force and effect.

16.3 Waiver: No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment: You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign these Terms without restriction. Any attempted assignment in violation of this provision is void.

16.5 Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, internet failures, or equipment failures.
